Billie’s Walk Photography is owned as a sole trader entity by AC Elliott, our registered address is 4 Andrews Terrace, Four Lanes, Redruth TR16 6QD.  Our website is www.billieswalk.co.uk  This website offers visitors greeting cards, photographic prints and other associated items.  By continuing to browse and use this website you are stating that you have read, understood, and agree to be bound by these Terms and Conditions. When buying an item, you agree that:

  • you are responsible for reading the full item listing before making a commitment to buy it

  • you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the payment process.

 

The prices we charge, inclusive of VAT, for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing is available on the payments page.

 

Intellectual Property/Trademarks

 

All material including, but not limited to, images, designs, logos and photographs displayed on the website www.billieswalk.co.uk and on our Facebook page  https://www.facebook.com/BilliesWalk are the property of AC Elliott and Billie’s Walk Photography and are protected by copyright as artistic works.  This continues to apply after the photographs and images have been sold as prints and greeting cards.  In the UK copyright in images usually lasts for the life of the creator plus 70 years from the end of the calendar year of their death.  Legal action will be taken if copyright is breached, and deliberate infringement of copyright on a commercial scale may also lead to a criminal prosecution.

 

Product Information & Warranties 

 

Products can be bought via the shopping basket on our website; on selection of the desired product payment will be taken via Square, our payment services provider, and we will send you a ‘Thank you for your order’ email.  Products may also be purchased in person at craft fayres and markets, or from one of our retail partners.  Products cannot be bought direct from our registered address.

 

There are no age restrictions on the products we sell, however we will not knowingly sell to an underage individual through our website.  If an item is out of stock, or for some other reason cannot be supplied you will be notified at the earliest opportunity.  An alternative product will be offered, or if unacceptable the order will be cancelled and a full refund given.  

 

We endeavour to give an accurate description of all products, and display prices correctly and clearly.  Please note that while the photographs are taken and processed in RGB colour standard, not all devices will display colours accurately and to the same standard.  Therefore, a small amount of colour variation may occur from screen to product.

Payment Terms

 

Direct sales

 

Full payment is required when you place an order. We will not dispatch any order until payment has been received and cleared.  Where payment does not clear, we have the right to cancel the order completely.

 

Trade orders

 

Exception to these payment terms for retail outlets only who are buying products for resale.  In placing an order with Billie’s Walk you are agreeing that you will have strictly net 30 days payment terms from date of invoice. All orders are firm sales.  Our preferred method of payment is by BACS.  In the event of late payment, we reserve the right to charge interest at the ‘statutory interest’ rate of 8% plus the Bank of England base rate.  We also reserve the right to charge a fixed sum of £40 to cover costs involved in chasing any payments.  Non-payment will result in a court claim application to a county court.  All items remain the property of Billie’s Walk until paid for in full.

Delivery Terms 

 

Direct Sales

For special orders or framed items please contact us for a quote.  All deliveries charges will be kept to the minimum, and we will agree this with you prior to confirmation of the order.

 

We will send out all orders as soon as possible, aiming to deliver your items within ten working days of you placing the order.  However, where an item is out of stock or is expected to take longer we will notify you, to the best of our ability, of an expected delivery date.  If this is not acceptable you have the right to cancel your order.  Special orders may take up to 30 days.  

 

Trade orders

 

For retail outlets buying our products for resale there is a minimum order value of £40.  This order should be delivered within ten days.  Deliveries are charged on a sliding scale which is listed on our Order Forms.  This cost will be confirmed when an order is placed.  Orders over £100 are carriage paid.  Any out of stock items will be advised as soon as possible after the order is placed. 

 

We cannot guarantee a delivery day, unless for large orders or where you have paid extra for a next day service.  We also cannot guarantee the quality of delivery by a third-party service.

Damaged or incorrectly delivered cards must be notified within 7 days.

 

Right to cancel

 

Under the Distance Selling Regulations you have the right to cancel your order within 14 days of receiving the products.  We must be notified within this timeframe and the items must be returned to us in the original condition; that is unused and in its original packaging.  You must send the items back to us at this address: Billie’s Walk, 4 Andrews Terrace, Four Lanes, Redruth TR16 6QD, at your own cost within 14 days of notifying us of your intent.

 

We reserve the right to make a charge not exceeding our direct costs of recovering the products if you do not return them or return them at our expense.  Once you have notified us that you wish to cancel the contract, any sum debited to us will be refunded to you as soon as possible and in any event within 30 days of your cancellation.

Billie’s Walk website is available to all users, for the purpose of viewing and purchasing our listed products only.  The information provided on this website is for general use only and whilst we have made every effort to ensure it is correct it may contain inaccuracies or errors.  We will not be held liable for any such errors.  Reproduction of any photographs, images, designs, logos, and all other copyrighted content is strictly prohibited.  Unauthorised use of any copyrighted item may give rise to a claim for damages and/ or criminal proceedings.

 

Disclaimer of liability

 

All products should be received in perfect condition.  Where this is not the case, on return of the damaged item we will either exchange the item or give a full refund within seven days.  We cannot guarantee a specified lifetime for the products provided as they are by nature liable to damage.  You are responsible for the care of all items once in your possession, and care must be taken to maximise the lifespan of them.  Billie’s Walk cannot be held responsible in the event of any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you, or other consumer.
